Judge Initiates Discovery In Massey Securities Action

Law360, New York (September 28, 2011, 4:56 PM EDT) -- Plaintiffs in a proposed securities class action against Massey Energy Co. won the right Wednesday in West Virginia to commence discovery of the catastrophic Upper Big Branch mine disaster, over the objections of the coal mining company's former officers and directors.

U.S. Magistrate Judge R. Clarke VanDervort approved an April compromise between the plaintiffs and the federal government that will allow for the production of all documents Massey provided to prosecutors and criminal investigators probing the April 2010 blast that left 29 miners dead.
