Pa. Can't Revive Landfill Cleanup Case Against CBS, Exxon

Law360, New York (September 29, 2011, 3:46 PM EDT) -- The Pennsylvania Department of Environmental Protection on Wednesday failed to revive a case seeking payment from Carnegie Mellon University, CBS Corp. and Exxon Mobil Corp. for the cleanup of hazardous waste from a western Pennsylvania landfill.

U.S. District Judge Lisa Pupo Lenihan declined to reconsider her November decision to dismiss the case against the three defendants, finding that it was past a three-year statute of limitations for certain claims under the Comprehensive Environmental Response, Compensation and Liability Act.
