Guidant Seeks To Exclude Testimony

Law360, New York (June 21, 2007, 12:00 AM EDT) -- With the first bellwether trial over Guidant Corp.'s allegedly defective implantable heart defibrillators rapidly approaching, the company is seeking to exclude certain expert witness testimony in the third bellwether case.

Guidant—which was acquired by Boston Scientific Corp. last year—said in documents filed Wednesday that the court should exclude certain expert witness opinions and testimony in the case of Leland Braund, the third bellwether plaintiff.

Braund and the second bellwether plaintiff, Eugene Clasby, have indicated their intent to offer the same expert witnesses as the first bellwether...
