Microsoft Forced To Divulge Trade Secrets Under E.U. Antitrust Ruling

Law360 (December 21, 2004, 12:00 AM EST) -- A Luxembourg court has ruled that Microsoft Corp. will have to abide immediately by the E.U.’s antitrust ruling, rejecting the software company’s claims that the court’s decision tramples on its intellectual property rights.

“After examining the circumstances of the case, the President finds that Microsoft has not shown that it might suffer serious and irreparable damage as a result of implementation of the contested decision,” the Luxembourg-based European Court of First Instance said. “Microsoft's application for interim measures is therefore dismissed in its entirety.”
