High Court May Hear Appeal Of Blocked Coal Plant

Law360, New York (October 3, 2011, 5:18 PM EDT) -- The U.S. Supreme Court on Monday asked the U.S. solicitor general to weigh in on whether to take up Sandy Creek Energy Associates LP’s appeal of a ruling that blocked its construction of a 900-megawatt coal power plant in Texas.

Sandy Creek is awaiting the Supreme Court’s decision on its petition for cert. Sierra Club and Public Citizen filed the suit in 2008, alleging the company began building the plant without regulatory approval, and last November the Fifth Circuit ruled that construction was green-lighted in violation...
