Imported LeMans Motorcycle Gear Is Apparel: Fed. Circ.

Law360, San Diego (October 3, 2011, 6:43 PM EDT) -- The Federal Circuit on Monday affirmed a decision that LeMans Corp.’s imported motorcycle jackets and motocross jerseys and pants should have been classified as apparel, not as sports equipment, which carried a lower duty rate.

The three-judge panel rejected LeMans’ arguments that its merchandise should have been categorized as sports equipment under Chapter 95 of the Harmonized Tariff Schedule of the United States because the articles were necessary for a sport and specifically designed for use in a particular sport.
