3rd Circ. Revives Pollution Suit Against Pigment Maker

Law360, New York (October 4, 2011, 7:36 PM EDT) -- The Third Circuit on Monday revived a environmental suit against lead pigment maker NL Industries Inc. and other defendants over heavy metal contamination in New Jersey's Raritan River, saying a lower court had improperly declined to take up the case.

Raritan Baykeeper Inc. and Edison Wetlands Association Inc. filed suit in August 2009 seeking to compel NL Industries, which manufactured pigments for decades on a 440-acre site near the river, to clean up arsenic, copper, lead, nickel and zinc that the plaintiffs allege the company illegally...
