USPS Tries To Duck Inspectors' OT Class Action

Law360, Los Angeles (October 3, 2011, 8:38 PM EDT) -- Government attorneys on Monday told a California federal judge that a class of current and former postal inspectors are prohibited from pursuing overtime claims under the Fair Labor Standards Act because of an administrative exemption in the statute.

But the attorneys faced an uphill battle to persuade U.S. District Judge James V. Selna to stray from his tentative decision denying their motion for summary judgment, just a month before the case is set to go to trial.
