Web Pharmacies Sold Generics Under Celgene Marks: Suit

Law360, New York (October 5, 2011, 4:57 PM EDT) -- Online discount pharmacies CanDrug USA and Northdrugstore.com were accused Monday of illegally using the names of Celgene Corp.'s cancer and blood disorder drugs to advertise and sell their generic equivalents, unfairly profiting from a false association with the drugmaker.

New Jersey-based Celgene and its subsidiary, Abraxis BioScience LLC, filed separate suites in New Jersey claiming that Northdrugstore.com and CanDrug — via its 164 sales websites — use the trademarked names Revlimid, Thalomid, Abraxane and Vidaza to describe generic forms of the drugs that customers can purchase...
