Fed. Circ. Nixes Arms Maker's $2M Trade Secrets Award

Law360, San Diego (October 6, 2011, 9:58 PM EDT) -- The Federal Circuit affirmed a ruling Thursday that Atlantic Research Marketing Systems Inc.’s military rifle accessory patent was invalid and vacated a jury’s award of $1.8 million against Troy Industries Inc. over trade secrets its founder allegedly stole while working for Atlantic Research.

The three-judge panel found that a Massachusetts district court properly invalidated Atlantic Research’s patent for failing to meet the written description requirement. It also vacated the jury’s verdict and reversed a denial of Troy’s motion for a mistrial, saying the lower court failed...
