Courts Say Lead Paint Companies Not Liable

Law360, New York (June 22, 2007, 12:00 AM EDT) -- The state supreme courts of New Jersey and Missouri have both ruled that former lead paint companies are not liable for the later effects of lead poisoning.

In both cases, municipalities had sued companies that manufactured lead paint before it was banned by federal law in 1978. This law declares that the use of lead paint is a public nuisance, and the plaintiffs in these cases argued that this language makes lead paint companies responsible for cleaning it up.
