ITC Can Ban Imports Over Foreign Secrets Theft: Fed. Circ.

Law360, New York (October 11, 2011, 7:08 PM EDT) -- The Federal Circuit on Tuesday affirmed the U.S. International Trade Commission’s decision that a Chinese importer of railway wheels violated federal trade law, finding the agency could decide cases in which the company in question misappropriated trade secrets outside the U.S. 

A three-judge panel said in a precedential 2-1 ruling that the ITC did not err in finding that China-based TianRui Group Co. Ltd. and its affiliates violated Section 337 of the Tariff Act by importing cast-steel railway wheels produced using Amsted Industries Inc.’s confidential information. ...
