Bringing Customs Back Into Revenue Enforcement

Law360, New York (October 21, 2011, 12:52 PM EDT) -- Senate Bill 1133, the Enforcing Orders and Reducing Customs Evasion Act of 2011, or the ENFORCE Act, is pending in Congress. It has broad support and is expected to become law in the near future. The bill will require U.S. Customs to investigate allegations that anti-dumping ("AD") or countervailing duty ("CVD") cases have been evaded. Although Customs has long had the authority to investigate such evasions, they just have not bothered to do so, (in much the same way that other Customs revenue-related laws are not really vigorously enforced)....
