Doctors Take ERISA Suit Against UMB To High Court

Law360, Washington (October 11, 2011, 5:40 PM EDT) -- Two doctors who unsuccessfully sued UMB Bank NA under the Employee Retirement Income Security Act asked the U.S. Supreme Court last month to revive their action, saying the bank was required to pony up extra information about an alleged securities fraud.

The petitioners, both doctors in Toledo, Ohio, were members of the Toledo Clinic Employees’ 401(k) Profit Sharing Plan, an ERISA-governed defined contribution plan, for which UMB acted as trustee. Tullis and Back sued the bank in 2006, claiming it had known about fraud on the...
