26 States Ask High Court To Hear Logging Runoff Fight

Law360, New York (October 17, 2011, 6:06 PM EDT) -- A coalition of 26 states urged the U.S. Supreme Court on Monday to review a Ninth Circuit ruling that stormwater runoff from logging roads required an environmental permit, arguing the lower court had misinterpreted the Clean Water Act.

At issue is the Ninth Circuit's rejection of the U.S. Environmental Protection Agency's Silvicultural Rule, which has been in place for more than three decades.
