US Must Do Enviro Review Of Polar Bear Rule: Court

Law360, New York (October 17, 2011, 8:22 PM EDT) -- A Washington federal judge on Monday ordered the U.S. Fish and Wildlife Service to vacate a controversial special rule on endangered polar bears, finding that the agency violated federal law by failing to do even a basic environmental review before it passed the rule in 2008.

The service violated the National Environmental Policy Act, and must now perform a basic environmental assessment to determine whether it must do a full-scale environmental impact statement, the court said. In the meantime, a largely similar interim rule will replace...
