Abbott, Lilly Fight Sales Reps' OT Claims In 7th Circ.

Law360, Chicago (October 18, 2011, 4:37 PM EDT) -- Attorneys for Abbott Laboratories Inc. and Eli Lilly & Co. told the Seventh Circuit on Tuesday that pharmaceutical sales representatives were exempt from overtime pay requirements, fighting separate employee class actions brought against their clients.

Daniel E. Reidy of Jones Day argued for Abbott in its challenge to a Northern District of Illinois ruling that a class of sales representatives are not exempt from premium overtime pay rates under the Fair Labor Standards Act because they don't actually make sales.
