Wind Farm Plans Trample Osage Tribe's Mineral Rights: Suit

Law360, New York (October 19, 2011, 6:17 PM EDT) -- An American Indian tribe in north-central Oklahoma sued the developers of a planned wind farm Tuesday, claiming the Wind Capital Group LLC's 94 turbines would illegally violate the tribe's mineral rights.

The Osage Nation asked for an injunction ordering the developers to abandon the 150-megawatt project, known as Osage Wind, as well as a judgment declaring the wind farm violates federal law that grants the tribe mineral rights in Osage County.

A spokesman for Wind Capital declined to comment Wednesday.
