FTC Warns NY Against Joint Health Care Negotiation Plans

Law360, New York (October 24, 2011, 4:13 PM EDT) -- The Federal Trade Commission on Monday urged New York lawmakers to reject a proposal to allow competing health care providers to jointly negotiate with insurers, saying the measure would likely cut access to services while boosting costs.

In response to a request from state Sen. John J. Bonacic, R-42nd District, the agency warned that consumers would probably be harmed by the plan to allow independent providers to coordinate on rate and other contractual negotiations beyond what is allowed under current antitrust laws.
