DC Circ. Nixes Ringling Bros. Elephant Cruelty Suit

Law360, Chicago (October 28, 2011, 5:14 PM EDT) -- The D.C. Circuit on Friday refused to revive a long-running suit accusing the operator of the Ringling Bros. and Barnum & Bailey Circus of abusing its Asian elephants in violation of the Endangered Species Act, finding the plaintiffs lack standing.

A three-judge panel affirmed a lower court's dismissal of the suit, agreeing that the Animal Protection Institute and a former Ringling Bros. barn helper had failed to show they had suffered sufficient injury to bring their claims challenging circus operator Feld Entertainment Inc.'s use of bull...
