Simon Property Rips Antitrust Suit Over Mall Leases

Law360, New York (November 1, 2011, 1:26 PM EDT) -- Mall developer Simon Property Group Inc. on Monday asked an Indiana federal judge to dismiss competitor Gumwood HP Shopping Partners LP's suit alleging interference with key retailers' lease agreements, saying Gumwood failed to state an antitrust claim.

Indianapolis-based Simon, which owns nearly 400 retail properties covering 261 million square feet on three continents, said Gumwood failed to show that the defendant monopolized a particular market by allegedly convincing two tenants to break their leases at the Heritage Square shopping center in Mishawaka, Ind.
