Insurer Off Hook For Trade Show Co.'s IP Suit: 2nd Circ.

Law360, New York (November 3, 2011, 2:14 PM EDT) -- The Second Circuit on Wednesday ruled that Great American Assurance Co. did not have to defend Rockland Exposition Inc. against a trademark infringement suit because the trade show promoter waited weeks before telling the insurer it had been sued.

Great American said the Middletown, N.Y.-based company had provided an oral notification about seven weeks after the Alliance of Automotive Service Providers of New Jersey had hit it with the underlying suit. Rockland also waited three months to send the insurer legal documents tied to the suit....
