Ex-Loan Officers Target PNC Bank In OT Class Action

Law360, New York (November 4, 2011, 6:49 PM EDT) -- Two former mortgage loan officers slapped PNC Bank NA with a putative class and collective action in Ohio on Thursday, claiming they were improperly classified as exempt from state and federal overtime pay requirements.

Named plaintiffs Lee Struck and Christopher Kusserow filed their complaint in Ohio federal court, naming PNC Financial Services Group Inc. subsidiary PNC Bank as the sole defendant and invoking the Fair Labor Standards Act, the Ohio Minimum Fair Wage Standards Act and the Ohio Prompt Pay Act.
