Hospital Workers Ask 1st Circ. To Reverse OT Ruling

Law360, New York (November 4, 2011, 4:19 PM EDT) -- A putative class of Caritas Christi hospital network employees on Thursday asked the First Circuit to reverse a district court's ruling that tossed their overtime case with prejudice, arguing they had sufficiently supported their claims.

The hospital employees said in a brief with the appeals court that U.S. District Judge George A. O'Toole Jr. wrongfully discounted their contention raised in a revised complaint that the Caritas network had skimped on overtime pay for more than 12,000 of its workers.
