Energy Drink Makers Defuse False Ad Fight

Law360, New York (November 14, 2011, 2:57 PM EST) -- Hansen Beverage Co., the maker of Monster energy drinks, agreed Thursday to drop its false advertising suit over rival Vital Pharmaceutical Inc.'s claims that its Redline brand provides seven hours of sustained energy.

The lawsuit, filed in California federal court in August 2008, claimed that Vital, known as VPX, has engaged in false advertising under the Lanham Act and violated California's unfair competition law with its claims about the benefits of Redline drinks.
