Watchmaker Omega Misused IP To Limit Imports: Judge

Law360, San Diego (November 14, 2011, 6:16 PM EST) -- A California federal judge last week dismissed watchmaker Omega SA’s suit against Costco Wholesale Corp., determining that Omega misused its copyright of a globe design on its watches by using its limited monopoly on that design to control the importation of its watches.

U.S. District Judge Terry Hatter Jr. granted Costco’s bid for summary judgment on Nov. 9 and denied Omega’s motion for partial summary judgment.
