DOE Beats Enviros' Challenge Of Berkeley Research Facility

Law360, New York (November 14, 2011, 6:29 PM EST) -- The U.S. Department of Energy won summary judgment Monday in an environmental challenge to a planned research facility on the University of California campus in Berkeley, with a federal judge ruling the agency had adequately examined the facility's environmental impact.

Environmental group Save Strawberry Canyon said the DOE had violated the National Environmental Policy Act by arbitrarily determining the project would have no significant environmental impact, a finding that allowed the agency to skip the more intensive environmental review needed to prepare an environmental impact statement....
