Ala., La. Can Seek Punitive Damages In Deepwater MDL

Law360, New York (November 14, 2011, 10:23 PM EST) -- The Louisiana federal judge in charge of the multidistrict litigation over the Deepwater Horizon oil spill ruled Monday that Louisiana and Alabama could seek punitive damages from BP PLC and others under general maritime law.

Echoing his Aug. 26 ruling on similar claims brought by individuals and businesses in the MDL, U.S. District Judge Carl Barbier said the states' claims of negligence and product liability under general maritime law against BP and Transocean Ltd. were not preempted because the states have sufficiently alleged physical damage....
