Insurers Ask 1st Circ. To Strip Cert. In ERISA Suit

Law360, New York (November 15, 2011, 9:14 PM EST) -- Two Cigna Corp. units on Monday asked the First Circuit to reverse a lower court’s decision to provisionally certify a class of life insurance beneficiaries who claim the insurers retained death benefits from employee plan policies for investments instead of paying them out.
