Label Doesn't Clear Merck From Vioxx Liability: Judge

Law360, New York (July 3, 2007, 12:00 AM EDT) -- A judge has rejected pharmaceutical giant Merck & Co.'s argument that its painkiller Vioxx, which allegedly increases patients' risk of heart attacks, was immune from product liability lawsuits once it updated its label to reflect this risk.

The company had moved to dismiss two individual suits in the multidistrict litigation over the drug on the grounds that the patients involved had begun taking the drug after its label had been updated to warn of the possibility of cardiac disease, in compliance with an FDA ruling. Merck...
