Hoboken Ordered To Rethink Vote Against Apartment Tower

Law360, New York (November 18, 2011, 3:45 PM EST) -- A New Jersey state appeals court on Wednesday directed the Hoboken City Council to reconsider its decision to block Kane Properties LLC from developing a 12-story residential tower in an industrial zone because an attorney advising the city on the matter had previously represented an adversary to the project.

The council ruled in April 2010 that the proposed apartment building exceeded the floor area, story height and building height restrictions posed by the street's designation as an industrial zone. The order revoked all variances previously awarded...
