CollaGenex Pharmaceuticals, West-ward Settle Patent Suit

Law360 (November 10, 2003, 12:00 AM EST) -- Dental and dermatological drugmaker CollaGenex and generic drugmaker West-ward Pharmaceutical Corporation settled all their pending litigation concerning patents for a periodontitis treatment, the two companies said Monday.

CollaGenex had sued West-ward and other defendants in the United States District Court for the Eastern District of New York, alleging that West-ward infringed CollaGenex's patents for Periostat for the treatment of adult periodontitis.

CollaGenex's complaint also alleged that West-ward infringed CollaGenex's patent rights under the Hatch-Waxman act by submitting an Abbreviated New Drug Application with the Food and...
