UPS, FedEx Again Dodge Consultant's Antitrust Suit

Law360, New York (November 28, 2011, 2:53 PM EST) -- A California federal judge on Wednesday tossed for the second time an antitrust suit brought by shipping consultant AFMS Logistics Management Group against UPS Inc. and FedEx Corp., finding that AFMS failed to prove the shipping giants stifled competition by refusing to deal with third-party consultants.

U.S. District Judge Margaret M. Morrow wrote that Portland, Ore.-based AFMS failed to demonstrate an injury to the shipping consultancy market beyond the company’s business losses, according to the order to dismiss.
