VW Says Fuse Box Defect Action Fails To Show Injury

Law360, New York (November 30, 2011, 6:57 PM EST) -- Volkswagen Group of America Inc. on Tuesday asked a Florida federal judge to dismiss a proposed class action accusing the automaker of knowingly selling vehicles with defective fuse boxes, referring to the suit's claims as "conclusory boilerplate."

Volkswagen argues that plaintiffs Richard and Judith Fickes have failed to show that they or anyone else in the putative class sustained any actual damage because of the alleged defect, let alone that the company is legally liable for it.
