CVS' $34M Overtime Settlement Faces Questions

Law360, New York (November 30, 2011, 10:07 PM EST) -- A federal judge Wednesday questioned the fairness of a proposed $34 million class action settlement with CVS Pharmacy Inc. in 11 wage-and-hour suits over the pharmacy services provider’s alleged failure to pay proper overtime to assistant store managers.

U.S. District Judge John J. McConnell said the parties would need to jointly explain why, according to the proposed agreement, any unclaimed settlement funds would be returned to the CVS defendants instead of either being divided among the class members or donated to a charitable fund to promote...
