Ind. Appeals Court Nixes Waste Cos.' Asbestos Claims

Law360, New York (December 6, 2011, 4:30 PM EST) -- An Indiana appeals court on Monday overturned a ruling in favor of two waste management companies in their row with insurers over asbestos claims, finding they are not entitled to coverage because the policies covered their predecessors and were not transferred.

In a published opinion, a three-judge panel ruled that the insurers, which included Continental Insurance Co. and National Fire Insurance Co. of Hartford, among others, were entitled to summary judgment because they never consented to a transfer of the policies they awarded the waste management...
