Builders Lack Standing To Fight CWA Finding: DC Circ.

Law360, New York (December 9, 2011, 6:09 PM EST) -- The D.C. Circuit refused Friday to revive a housing developer group's suit fighting a decision by regulators to shield tracts of Arizona's Santa Cruz River under the Clean Water Act, ruling the group lacked standing to sue over the designation.

A lower court had found in August 2010 that it could not review the U.S. Environmental Protection Agency's determinations unless the agency had brought an enforcement action over the rules or handed down an adverse permitting decision.
