11th Circ. Nixes FTC Bid To Halt $195M Ga. Hospital Deal

Law360, New York (December 12, 2011, 6:53 PM EST) -- The Eleventh Circuit refused Friday to block Phoebe Putney Health System Inc.'s $195 million acquisition of Palmyra Park Hospital Inc. even though the deal would likely create a monopoly, ruling that a Georgia law shielded the deal from the Federal Trade Commission's antitrust challenge.

A three-judge panel concluded that the transaction was protected by the state action doctrine, which provides states and state agencies with federal antitrust immunity under certain conditions, upholding the district judge's refusal to enjoin the deal while the FTC's administrative case proceeded....
