4th Circ. Revives Contract Claim Over 'Dictatorial' Boss

Law360, New York (December 14, 2011, 12:56 PM EST) -- The Fourth Circuit ruled Tuesday that a Maryland federal court erred in dismissing a government subcontractor's breach of contract suit accusing its prime contractor of driving away its employees through the boss' “dictatorial” management style.

In an unpublished opinion, the appeals panel ruled that the lower court was wrong to find that the suit lacked subject matter jurisdiction. The appeals court found that the record on the central question of the case was not yet clear and therefore not ripe for such a dismissal.
