Insurer Wants Off The Hook For Boiler Explosion

Law360, New York (December 14, 2011, 3:56 PM EST) -- Evanston Insurance Co. launched a suit Tuesday in Texas federal court, seeking to avoid defending Horizon Consultants Inc. in litigation blaming the company's allegedly defective software for a deadly steam boiler explosion at an oil refinery in Texas City.

The insurer filed a declaratory judgment suit seeking a ruling that it does not have to indemnify Louisiana-based Horizon in an underlying suit filed by Valero Refining – Texas LP over the December 2009 explosion in Texas City, which killed one employee and injured others, according to...
