AEP Will Shutter Upwind Plant To Save $1.7B Ark. Facility

Law360, New York (December 22, 2011, 3:27 PM EST) -- An American Electric Power unit will retire a coal-fired power plant in Texas in order to settle claims by the National Audubon Society and Sierra Club seeking to block construction of a new $1.7 billion plant in Arkansas, the groups announced Thursday.

The parties filed a consent decree in Arkansas federal court Thursday.

The environmental groups claimed that the U.S. Army Corps of Engineers, in approving the John W. Turk Jr. Power Plant near Texarkana, Ark., had violated the National Environmental Policy Act and other laws....
