Class Bids Nixed Again In MDL Over BPA In Baby Bottles

Law360, Chicago (December 22, 2011, 9:14 PM EST) -- A Missouri federal judge on Thursday shot down class certification bids by consumers suing Gerber Products Co. and others in multidistrict litigation over the use of bisphenol A in baby bottles and sippy cups, finding the proposed classes were too broad.

U.S. District Judge Ortrie D. Smith denied the motions for certification of three classes of Missouri consumers bringing claims of unjust enrichment, breach of the implied warranty of merchantability and violation of the Missouri Merchandising Practices Act against Gerber, Handi-Craft Co. and Evenflo Co. Inc....
