Importer Must Repay Insurer For Peanut Duties: 5th Circ.

Law360, New York (December 23, 2011, 2:39 PM EST) -- The Fifth Circuit on Thursday upheld a ruling that Sweet Little Mexico Corp. must repay its insurer for duties it paid on the company's Mexican peanut imports, rejecting the importer's claim that the dispute belonged in the U.S. Court of International Trade.

The appeals court affirmed a Texas federal court's grant of summary judgment to International Fidelity Insurance Co., which sued SLM for reimbursement the $1.6 million that it paid in duties to U.S. Customs and Border Protection on the company's behalf.
