Docs' Businesses Can Challenge Medicare Rule: DC Circ.

Law360, New York (December 23, 2011, 2:54 PM EST) -- The D.C. Circuit on Friday ruled that physician-owned medical equipment suppliers can bring a court challenge to a Medicare Act rule that effectively put them out of business, dismissing the government's claims that the suppliers are barred from both administrative and judicial review.

The challenge was brought by the Council for Urological Interests, a group of physician-owned joint ventures that purchase special equipment for laser surgery and provide the equipment and related services to hospitals. The ventures' business comes largely from referrals from the doctors who...
