7th Circ. Cites Anna Nicole In Nixing Debtors' Appeals

Law360, New York (January 3, 2012, 7:48 PM EST) -- The Seventh Circuit ruled Friday it could not review a bankruptcy court's decisions favoring Aurora Health Care Inc. in two proposed privacy class actions brought by debtors, pointing to the U.S. Supreme Court's decision in the Anna Nicole Smith case.

The bankruptcy judge did not have the constitutional authority to enter summary judgment for Aurora on the debtors' Wisconsin law claims, which alleged Aurora violated their privacy by filing their health records with bankruptcy courts without permission, according to a three-judge panel.
