Infineon Claims Rambus Destroyed, Re-Created Evidence In Patent Suit

Law360, New York (February 5, 2005, 12:00 AM EST) -- Attorneys for German chip designer Infineon Technologies AG told a federal judge that a patent lawsuit brought by U.S. rival Rambus Inc. should be thrown out due to evidence destruction, perjury and other misconduct by the plaintiff.

Last week, Infineon attorney and Kirkland & Ellis partner John Desmarais told U.S. District Judge Robert Payne in the U.S. District Court for the Eastern District of Virginia that Rambus had systematically destroyed company documents and had attempted to keep that fact hidden from Infineon.
