US Steel's Testimony Ruling Challenge Nixed By High Court

Law360, New York (January 9, 2012, 8:46 PM EST) -- The U.S. Supreme Court on Monday rejected U.S. Steel Corp.’s challenge to a ruling that a district court misapplied an important precedent regarding scientific testimony in a suit brought by a worker who alleged he developed leukemia from exposure to benzene.

In a short order, the court denied U.S. Steel’s petition to overturn a First Circuit decision allowing plaintiff Brian Milward to use a toxicologist’s testimony to support claims that routine exposure to benzene at work triggered his acute promyelocytic leukemia.
