National Union Scores Again In Row With Carbon Black Co.

Law360, New York (January 10, 2012, 5:17 PM EST) -- In the latest in a long-running insurance dispute, a Texas federal judge on Monday ruled that the umbrella policies held by Continental Carbon Co. do not require its insurer to cover $28 million in legal fees and a $20.7 million settlement stemming from pollution suits over the company's carbon black plant in Alabama.

The decision was another victory for National Union Fire Insurance Co. of Pittsburgh, Pa., which has maintained that it owes neither defense nor indemnity to Continental. An arbitration panel, an Oklahoma federal court...
