States Challenge Medicaid Expansion In Supreme Court

Law360, New York (January 10, 2012, 10:18 PM EST) -- More than two dozen states led by Florida on Tuesday filed a brief with the U.S. Supreme Court challenging the Patient Protection and Affordable Care Act's mandatory expansion of Medicaid, which the states call unconstitutional.

The 26 states argue that the health care reform bill abuses congressional spending power and unconstitutionally coerces states into spending billions of dollars on expanding their Medicaid programs by threatening states with the loss of all federal Medicaid funding if they do not comply.
