Discovery Bid Heads To Canada In Lantheus Coverage Suit

Law360, New York (January 12, 2012, 4:15 PM EST) -- A New York federal judge on Wednesday allowed Lantheus Medical Imaging Co. to take a discovery request to Canadian courts in a dispute over coverage for business interruption losses stemming from the shutdown of a Canadian nuclear reactor that supplied the company with radioactive material.

Massachusetts-based Lantheus sued Zurich American Insurance Co. in December 2010, saying the insurer must pay up under a $70 million "all risks" policy after the 15-month shutdown of Atomic Energy of Canada Ltd.'s Chalk River reactor in Ontario. The Chalk River...
